Are your assets well protected?

The purpose of a trademark is to prove to the whole world that as a person or company, YOU are at the origin of a concept, an exceptional product, a work of excellence. diverse nature or a very distinctive service, and that it was you who is the source thereof. Is that the case? It’s time to think about the trademark! Make an appointment now to collect all the benefits owed to you!

What is a trademark?

The trademark is in fact a certification which serves to distinguish the products or services of a company from those of others but also to protect them. In this sense, it makes its brand, its business assets and its reputation exclusive to the company. So, when you see the symbol ® which accompanies a name, it is because it has been registered. The ™ symbol represents a non registered trademark.

Trademarks are divided into three main categories, namely regular marks, certification marks and even distinctive guise. In the first case, there are different forms: words, sounds, logos, images, etc. which make it possible to distinguish a company’s offering from those of others. The second category, the certification mark, is based on a defined standard and can be granted only to an entity which does not actually use the mark but authorizes others to use it. Finally, the distinctive guise represents the shape of a product, its container, its packaging or the packaging applied to it, which makes it possible to associate it to a very specific company.

At the same time, a trademark makes you think of other concepts? So here are some additional IP concepts! Thus, the patent is a title giving an exclusive right of exploitation for a specific time, conferred by the government to a person who is the author of a discovery of an industrial invention. Copyright represents the exclusivity for an original work of literary, artistic, dramatic or musical type with regard to the rights of reproduction, publication or performance while an industrial design represents the novel appearance or ornamentation of an object.

What is the value of trademark?

On the face of it, the value of a brand increases over time if certain basic precautions are taken. Thus, a trademark is useful to differentiate yourself from your competitors through your products and services. It is therefore essential to protect your brand and your offer in a very crowded consumer world. How to register a trademark?

Registering a trademark ensures that the reproduction rights are exclusively assigned to you. A registered trademark is registered in the Register of Trademarks and is identified by a registration certificate, a document which certifies that this trademark belongs to you. To do this, the ideal remains to entrust the mandate to an expert, because depending on the type of registration requested, the process can prove to be difficult, especially since the forms to be completed can be easily mis-filled. This may be prevented by taking advantage of the expertise of a professional in the field, who knows the jargon well and who is familiar with the process. You will save time and money and will have exclusive rights to your product or service for 10 years.

It is possible to register a trademark in Canada and/or any other country such as the United States, for example. If you plan to export your products to Europe or China, it would be to your advantage to also register it in these territories, otherwise, you could be copied and gain significant notoriety and undeniable financial advantages which would otherwise be yours by right. In Canada, the Canadian Intellectual Property Office (CIPO) is responsible for this aspect of business.
